Summary

Join our experts as they discuss the numerous ethical implications associated with addressing liens in personal injury cases.  You will learn how to protect your client, you and your firm from lawsuits for recovery under ERISA and double damages under the MSP Act's private cause of action provision. Additionally, important updates and strategies for addressing Medicare, Medicare Advantage, Medicaid, ERISA, Tricare and VA liens will be provided. They will also review developing State case law and Federal statutory law, covering the 11th Circuit's decision in Gallardo v. Dudek, which threatens to distort the Ahlborn decision and to permit recovery of all medical expenses by the Medicaid Agency and the proposed federal rule which will attempt to "clarify" rules regarding Medicare Set-Asides, respectively.
