Medical Indemnity Fund

 

The MIF was established in 2011 to provide a dedicated funding source for the future health care costs of individuals with birth-related neurological injuries due to medical malpractice during delivery.  

Current Status: As of June 2024, the MIF has reopened to prospective enrollees, with applications subject to specific eligibility requirements. The fund continues to support “qualified plaintiffs” by covering various medical expenses, including hospital care, surgical care, nursing care, and assistive technology.

The MIF is a resource for ensuring that clients receive the necessary long-term care without the financial strain typically associated with such extensive medical needs. The fund is facing significant financial challenges. Despite recent efforts to secure additional funding, including a $58 million allocation by Governor Hochul, the fund is projected to run out of money by next spring. Without further financial support, the MIF will be unable to continue enrolling new participants or covering the extensive medical costs for those already enrolled. This situation underscores the urgent need for alternative and sustainable funding solutions to ensure those injured are cared for and made whole.
